These Terms & Conditions apply when you use the Aafaq Bookstore UK website or purchase products from us online. Please read them before placing an order.

These Terms should be read together with our Shipping & Delivery, Returns & Refunds and Privacy Policy.

Nothing in these Terms affects your statutory rights as a consumer.

2. Using our website

You may use our website for lawful personal use.

You must not misuse the website, attempt to gain unauthorised access to our systems or customer accounts, interfere with the operation of the website, or use the website in a way that infringes the rights of another person.

We may occasionally suspend or restrict parts of the website for maintenance, security, technical or operational reasons.

You may save or print these Terms for your personal records.

3. Customer accounts

You may be able to create a customer account when using our website.

You are responsible for providing accurate information and keeping your account login details secure.

Please contact us if you believe somebody has gained unauthorised access to your account.

We may suspend or restrict an account where we reasonably believe it is being used fraudulently, unlawfully or in breach of these Terms.

4. Products and book information

We aim to provide accurate information about products offered on our website, including titles, authors, ISBNs, formats, languages, publishers, descriptions and prices where applicable.

Publishers and suppliers may occasionally change book covers, artwork, packaging or other presentation details.

Where a particular edition, language, format, cover or ISBN is important to you, please check the product information carefully or contact us before ordering.

We will not knowingly substitute a materially different product without your agreement.

All products are subject to availability.

5. Product availability

Adding an item to your basket does not reserve that item.

Occasionally, an item may become unavailable after an order has been placed because of simultaneous purchases, stock adjustments or other inventory changes.

If we are unable to supply an item you have ordered, we will inform you and refund any amount already paid for the unavailable item.

6. Prices

Prices displayed on our UK website are shown in pounds sterling (GBP) unless stated otherwise.

Prices include applicable taxes where required.

Any applicable delivery charges will be shown during checkout before you complete your order.

We take reasonable care to ensure that prices are correct. If we identify an obvious pricing error before accepting an order, we may contact you and give you the opportunity to continue at the correct price or cancel the affected item.

7. Placing an order

When you place an order through our website, you are offering to purchase the selected products subject to these Terms.

Before completing your order, please check your products, quantities, delivery or collection option, delivery address and payment information carefully.

After placing an order, you will normally receive an automated confirmation that we have received it.

A contract for the relevant products is formed when we accept your order. Acceptance will normally take place when we confirm that the order has been dispatched or, for Click & Collect, when we confirm that the order is ready for collection.

If we cannot accept or fulfil an order, for example because an item is unavailable, payment cannot be authorised, an obvious error has occurred, or we cannot deliver to the address provided, we will inform you.

If payment has already been taken for an order or item that we cannot supply, the relevant amount will be refunded.

8. Payment

Available payment methods are shown during checkout.

Payments may be processed securely by third-party payment providers.

You confirm that you are authorised to use the payment method provided with your order.

If payment cannot be authorised or is subsequently reversed, we may be unable to process or dispatch the order.

9. Delivery

Available delivery services, estimated delivery times and applicable charges are shown during checkout and on our Shipping & Delivery page.

Please make sure the delivery address you provide is complete and accurate.

Delivery times are estimates unless we expressly confirm that a particular delivery date is guaranteed.

We will take reasonable steps to deliver your order within the timeframe communicated to you.

Unless a different delivery period has been agreed, goods will be delivered within the period required by applicable UK consumer law.

If a significant delivery delay occurs, your statutory rights remain unaffected.

10. Click & Collect

Where available, you may choose Click & Collect from our London store during checkout.

Please wait until you receive confirmation that your order is ready before visiting the store.

11. Cancelling an online order

For most eligible goods purchased online, consumers have the right to change their mind without giving a reason.

You generally have 14 days after receiving the goods to tell us that you wish to cancel.

After notifying us, you generally have a further 14 days to return the goods.

To cancel an eligible order, contact: info@aafaq.co.uk. Please provide your name and order number where possible.

You may also use the cancellation form available on our Returns & Refunds page, although you are not required to use that form.

12. Exceptions to change-of-mind cancellation rights

UK consumer law provides certain exceptions to the normal right to cancel.

Depending on the product, these may include personalised or custom-made goods, certain perishable goods, newspapers and magazines, certain sealed audio, video or software products once unsealed, and sealed goods that cannot be returned for health or hygiene reasons once opened.

These exceptions do not remove your statutory rights where goods are faulty, damaged, incorrectly supplied or not as described.

Ordinary books are not excluded from the normal online cancellation right simply because they are books.

13. Change-of-mind returns

Please follow the instructions on our Returns & Refunds page before returning an item.

For an eligible change-of-mind return, you are responsible for the direct cost of returning the goods to us unless we agree otherwise.

You may inspect an item in the same way that you reasonably could in a shop. Where permitted by law, we may make an appropriate deduction from a refund if handling beyond what was necessary has reduced the value of the goods.

14. Refunds

For an eligible online cancellation, we will provide the refund required under applicable consumer law.

Where required, this includes the price paid for the returned goods and the cost of our least expensive standard delivery option.

If you selected a more expensive delivery option, such as Express delivery, the additional amount above our standard delivery cost will not normally be refunded.

Where permitted by law, we may wait until the goods have been returned or you provide evidence that they have been sent back before issuing a change-of-mind refund.

Refunds will normally be made to the original payment method.

15. Faulty, damaged, incorrect or misdescribed goods

We have a legal obligation to supply goods that comply with applicable consumer law.

Goods must, where applicable, be of satisfactory quality, fit for their intended purpose and as described.

If an item is faulty, damaged, incorrectly supplied or not as described, please contact us as soon as possible.

Your statutory rights in relation to faulty goods are separate from our change-of-mind policy. Depending on the circumstances, you may be entitled to a refund, repair or replacement.

UK consumer law provides a short-term right to reject qualifying faulty goods, normally within 30 days, subject to the applicable legal conditions.

This does not mean that Aafaq Bookstore offers a general 30-day change-of-mind returns policy.

Nothing in these Terms limits your statutory consumer rights.

16. Purchases made in our physical store

The statutory change-of-mind cancellation rules applying to online purchases do not automatically apply to non-faulty goods purchased inside our physical store.

Any voluntary return or exchange arrangement for a non-faulty in-store purchase will depend on the store policy applicable at the time.

Your statutory rights relating to faulty, misdescribed or otherwise non-conforming goods remain unaffected.

17. Promotions and discount codes

From time to time, we may offer promotions, discounts or promotional codes.

Individual promotions may have additional conditions, including validity dates, minimum-spend requirements, product exclusions or eligibility requirements.

Unless stated otherwise, promotional codes have no cash value.

We may refuse the use of a promotion where we reasonably believe it has been used fraudulently or where an obvious technical error has occurred.

Promotions do not affect your statutory consumer rights.

18. Intellectual property

The Aafaq name, branding, logos, website design, text, graphics, photographs and other website material may be protected by intellectual property rights belonging to Aafaq Bookstore or third parties.

You may use the website for your personal, non-commercial purposes.

You must not commercially copy, reproduce, distribute or exploit protected website content without permission from the relevant rights holder.

19. Privacy and cookies

We process personal information in accordance with our Privacy Policy and applicable UK data-protection law.

Our website also uses cookies and similar technologies. Where consent is required for non-essential cookies, you can manage your choices through the privacy and cookie controls available on our website.

20. Our responsibility to you

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any liability or statutory consumer right that cannot legally be excluded or restricted.

If we fail to comply with these Terms, we are responsible for loss or damage that is a reasonably foreseeable result of our breach or failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable.

Where products are purchased as a consumer for personal use, we are not responsible for business losses such as loss of profit, revenue or business opportunity where the law permits this limitation.

21. Events outside our reasonable control

An order may occasionally be affected by circumstances outside our reasonable control, such as severe weather, transport disruption, carrier problems, system failures or other unexpected events.

Where this happens, we will take reasonable steps to minimise the effect and deal with the order appropriately.

Your statutory consumer rights remain unaffected.

22. Changes to these Terms

We may update these Terms & Conditions from time to time to reflect changes to our business, website, services or applicable law.

The version applying to an order will normally be the version in force when that order was placed.

The latest version will be published on this page together with its most recent update date.

24. Governing law

These Terms & Conditions and contracts for purchases made through our UK website are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you continue to benefit from any mandatory consumer protections applicable to you and may use the courts available to you under applicable law.

25. General

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

If we do not immediately enforce a right under these Terms, this does not mean that we have given up that right.
